ASMR Compass Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the web service "ASMR Compass" (the "Service") provided by the operator of ASMR Compass (the "Operator").

Anyone who uses the Service (a "User") shall review the contents of these Terms and use the Service only after agreeing to them.

Article 1 (Application)

These Terms apply to all relationships between the Operator and Users in connection with the provision and use of the Service.
Any guidelines, notices, privacy policy, or other rules that the Operator publishes on the Service form part of these Terms.
If these Terms conflict with any individual provision posted on the Service, that individual provision shall prevail unless it states otherwise.

Article 2 (Content of the Service)

The Service collects and organizes ASMR videos, channels, and related information published on YouTube and elsewhere, and provides search and browsing functions based on Humidity, material, action, character, location, recording technique, and other conditions.

The Service may provide the following functions:

Search for ASMR videos and channels
Filtering by Humidity and other classification information
Display of videos, channels, and related information
Playback of videos or links to external services
A Playback Stack and a fixed player
Introduction of works available on DLsite and other external services
Display of advertising and affiliate links
Other functions the Operator may add

Videos, images, audio, descriptions, product information, and other external content displayed on the Service are, in principle, provided by the respective rights holders or external services.

The Service is not a service directly provided or operated by YouTube, Google, DLsite, or any other external service operator, except where expressly stated otherwise.

Article 3 (Conditions of Use)

Users shall use the Service in compliance with these Terms and applicable laws.
Users shall prepare, at their own expense and responsibility, any device, software, communication line, or other environment necessary to use the Service.
Users shall bear any communication fees or other costs incurred in using the Service.
Minors shall use the Service only after obtaining the consent of a parent or other legal representative where necessary.
Where an external service linked from the Service imposes an age restriction, Users shall comply with the age requirements of that external service.

Article 4 (Use of External Services)

The Service may use services, APIs, embedded features, or external links provided by YouTube, Google, DLsite, and other third parties.
When a User uses an external service, the terms of service, privacy policy, and other rules of that external service apply.
Transactions such as video playback, purchases, membership registration, payment, refunds, delivery, or inquiries on an external service take place between the User and that external service or seller.
The Operator does not guarantee the content, availability, safety, legality, accuracy, continuity, or outcome of transactions on external services.
The display or functionality of the Service may change due to specification changes, discontinuation, API restrictions, content removal, or other circumstances affecting external services.

Article 5 (Search Results and Classification Information)

Humidity, tags, categories, relevance, popularity, recommendations, and other classification information displayed on the Service may be generated using public information, dictionaries, algorithms, machine learning models, and similar tools.
Classification information is intended to assist Users in searching and does not necessarily represent the content of a video or work completely or objectively.
The Operator does not guarantee the accuracy, completeness, timeliness, fitness for a particular purpose, or conformity with a User's subjective expectations of search results and classification information.
Search results or classification information for the same video or work may change due to changes in classification methods, data updates, or other reasons.
Users shall confirm the actual content, description, age rating, and other conditions of a work on each external service before use.

Article 6 (Advertising and Affiliates)

The Service may include advertising, affiliate links, sponsored displays, and other commercial content.
If a User purchases a product or service through an affiliate link on the Service, the Operator may receive a referral fee or other compensation.
Where content constitutes advertising or an affiliate link, the Service will indicate this as necessary so that Users can recognize it as such.
Matters such as contracts, purchases, payment, provision, returns, refunds, and quality assurance for products and services listed as advertising or affiliate content are handled between the User and the advertiser, seller, or external service.
The Operator does not guarantee the quality, safety, legality, usefulness, or purchase outcome of products and services listed as advertising or affiliate content.

Article 7 (Prohibited Conduct)

Users shall not engage in any of the following conduct when using the Service:

Acts that violate laws or public order and morals
Acts related to criminal activity
Acts that infringe the rights or interests of the Operator, other Users, rights holders, or third parties
Acts that infringe copyrights, trademark rights, rights of publicity, privacy rights, honor, or other rights
Unauthorized access to the Service or an external service
Acts that place an excessive load on the Service's servers, network, database, or systems
Acts that probe, verify, or exploit vulnerabilities in the Service
Acts that circumvent the Service's security features or access controls
Sending malware or other harmful programs or data
Acts that interfere with the normal operation of the Service
Reproducing, modifying, reposting, redistributing, or selling all or part of the Service without the Operator's permission
Accessing the Service or collecting information at scale through automated means beyond the ordinary manner of use provided by the Operator
Analyzing or attempting to obtain the Service's source code, internal structure, or non-public mechanisms for wrongful purposes
Improperly manipulating advertising, affiliate links, or measurement features displayed on the Service
Making false inquiries, rights-infringement claims, or removal requests
Impersonating another person
Using the Service to cause disadvantage, damage, or discomfort to a third party
Any other conduct the Operator reasonably deems inappropriate

Article 8 (Intellectual Property Rights)

Copyrights, trademark rights, and other intellectual property rights relating to the Service's name, logo, design, screen layout, programs, databases, proprietary classification system, descriptions, and other content created by the Operator belong to the Operator or the rightful rights holder.
Rights relating to external content such as YouTube videos, thumbnails, channel names, work images, and product descriptions belong to the respective uploaders, creators, sellers, platforms, or other rights holders.
The display of external content on the Service does not mean that rights to that content have been transferred to the Operator.
Users shall not use the Service or the content posted on it beyond the scope permitted for personal use or otherwise permitted by law.
With respect to individual information such as search conditions, tags, and classification results on the Service, the Operator does not claim exclusive rights over facts or information that are not protected by law.

Article 9 (Response to Rights Infringement and Listed Information)

A rights holder who believes that information posted on the Service infringes a copyright, trademark right, right of publicity, privacy right, or other right may make a report through the contact point designated by the Operator.

When making a report, please provide, in principle, the following information:

The reporter's name
Contact details
Information confirming that the reporter is the rights holder or a duly authorized representative
The page or content in question
The right alleged to be infringed
The specific reasons for concluding that infringement has occurred
The requested action

The Operator will review the content of the report and take reasonable action as necessary, such as suspending the listing, correcting information, or removing an external link.

The Operator may request additional materials to confirm the content of a report.

If a false or improper report causes damage to the Operator or a third party, the reporting party may be held liable for that damage.

The Operator does not guarantee that it will take removal or any other action in response to every report.

Article 10 (Changes to the Service)

The Operator may change the content or specifications of the Service for reasonable grounds such as improving the Service, responding to laws and regulations, changes to external services, or technical or operational necessity.
Where a change would have a material impact on Users, the Operator will endeavor to give reasonable advance notice.
Minor changes, urgent security responses, and other cases where advance notice is difficult may be announced after the change is made.

Article 11 (Suspension and Termination of the Service)

The Operator may temporarily suspend all or part of the Service in any of the following cases:

When performing system maintenance, inspection, or updates
When a failure occurs in a server, communication line, or external service
When unauthorized access, a cyberattack, or another security issue occurs
When an earthquake, fire, power outage, disaster, or other force majeure event occurs
When responding to a law, an order from a government agency or court, or similar requirement
In any other case the Operator reasonably deems the suspension necessary

The Operator may discontinue all or part of the Service for reasonable grounds such as operational, technical, or economic circumstances.

When discontinuing the Service, the Operator will endeavor to give reasonable advance notice on the Service, except in urgent or unavoidable circumstances.

Where the Service is provided free of charge and is not primarily intended to store User data, the Operator has no obligation to migrate or preserve search conditions, the Playback Stack, settings, or other data held on a User's device upon termination of the Service.

Article 12 (Disclaimer of Warranties)

The Operator does not expressly or impliedly warrant any of the following with respect to the Service:

Accuracy
Completeness
Timeliness
Usefulness
Safety
Continuity
Fitness for a particular purpose
That the search results a User expects will be obtained
That no errors, defects, or interruptions will occur
That no harmful programs or other security issues exist

The Operator strives to correct and update listed information but does not guarantee that all information will always be kept up to date and accurate.

The Service does not provide medical, sleep-therapy, mental-health, or other professional advice or diagnosis.

Users shall use the Service and external content at their own discretion and responsibility, with due regard to volume, viewing time, physical condition, and surrounding circumstances.

Article 13 (Damages and Exemption from Liability)

The Operator is not liable for damage incurred by a User for reasons not attributable to the Operator.
The Operator is not liable for damage incurred by a User in connection with the use or inability to use the Service, search results, classification information, external content, external services, advertising, affiliate products, or other matters relating to the Service, except where the Operator has acted intentionally or negligently.
Where damage is incurred by a User due to the Operator's slight negligence, the Operator is liable only for the actual and ordinary direct damage incurred by the User, and is not liable for special damages, indirect damages, lost profits, loss of data, or other consequential damages, regardless of foreseeability.
The preceding paragraphs do not apply where the Operator has acted with intent or gross negligence, or in any other case where a limitation or exemption from liability is not permitted by law.
Disputes arising between a User and an external service, poster, seller, advertiser, or other third party shall be resolved between that User and the third party, except where the dispute arises from a cause attributable to the Operator.

Article 14 (User Responsibility)

If a User violates these Terms or the law and causes damage to the Operator or a third party, that User shall be responsible for compensating the damage.
If a third party makes a claim, objection, complaint, or other demand against the Operator arising from a User's improper use of the Service, the User shall respond to it at their own responsibility and expense, except where the cause is attributable to the Operator.
If the Operator confirms that a User has engaged in prohibited conduct, the Operator may take necessary measures such as restricting access, blocking communications, or reporting to relevant authorities.

Article 15 (Handling of Personal Information)

The Operator's handling of User information is governed by the separately established Privacy Policy.

Article 16 (Changes to These Terms)

The Operator may change these Terms in accordance with law in any of the following cases:

Where the change conforms to the general interests of Users
Where the change does not conflict with the purpose of using the Service and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances
Where the Operator has otherwise obtained the consent of Users

When changing these Terms, the Operator will publicize the content of the change and its effective date by posting on the Service or another appropriate method.

The revised Terms take effect from the announced effective date.

For changes that require a User's consent under applicable law, the Operator will obtain that consent by a separate, appropriate method.

Article 17 (Severability)

Even if part of these Terms is held invalid or unenforceable by a law or a court decision, the remaining provisions shall continue in full force and effect.

Any provision held invalid or unenforceable shall be interpreted to have the valid effect closest to its original intent.

Article 18 (Assignment of Rights and Obligations)

A User shall not assign, transfer, or create any security interest in their position under these Terms or the rights and obligations arising from these Terms to a third party without the Operator's prior consent.
If the Operator transfers the business relating to the Service to a third party, the Operator may, in accordance with law, cause that third party to succeed to the Operator's position, rights and obligations under these Terms, and the information necessary to operate the Service.

Article 19 (Governing Law and Jurisdiction)

The formation, validity, performance, and interpretation of these Terms are governed by the laws of Japan.
If a dispute arises regarding the Service or these Terms, the Operator and the User shall attempt to resolve it through good-faith consultation.
If the dispute is not resolved through consultation, the district court or summary court having jurisdiction over the location of the Operator shall be the exclusive court of first instance by agreement of the parties, except where otherwise provided by law.
